Today I will try to describe you the real situtation in
Turkish football and inform you about what had really happened in Turkey in the
last two years since the beginning of one of the biggest corruption stories
of European football. I guess the
scandal seems to be handled in a proper way from a distance. However, the truth
is that: it does not.
There are various definitions for match fixing but
what I like most is the one Graham Peaker, the UEFA intelligence officer, used: in a poetical way,
he describes match fixing as “cheating to lose.” However, in some parts of the
world like Turkey, “the art of losing isn’t hard to master” if you possess
three critical powers, which are:
Politics, Economics and Media.
The main party of Turkish match fixing scandal was holding all of these
three and made really good use of them…
In July 2011, the
police investigation uncovered an organized crime syndicate that was involved
in fixing several games. Fenerbahce SK was at the center of the scandal, whose
board members were charged with fixing 12 matches in spring 2011 which led
Fenerbahçe to win the title ahead of Trabzonspor with an unbelievable 16 wins
out of 17 games. Dozens of officials including Aziz Yildirim, chairman of
Fenerbahce, were arrested and several players, managers and agents were also
charged in match fixing probe. After a whole year, the criminal court gave its
verdicts in 2nd July 2012 and sentenced 21 suspects for manipulating
the results of matches in 2010-2011. You can see some of the sentences behind.
Although the match fixing activities in Turkish Super League
and second division were proved, the sport jurisdiction were manipulated to
save the clubs from getting deserved sentences. The laws, regulations, instructions
and reports were changed, activities of individuals and legal entities were
differentiated and thereby the clubs benefited from the fixing activities of
their officials were cleared which sounds unbelievable.
Fenerbahce and Besiktas were proven guilty as charged by the
disciplinary bodies of the UEFA and they were punished. However, Turkish
Federation is unwilling to readjust its unfair and unreasonable decisions due
process of law.
We can narrow down the process of clearing the match fixer
clubs with 3 decisive steps guided by both political and economical desires
together with the help of corrupted media.
Turkish
Football Federation was ruled by a former Fenerbahce board member, Mr. Mehmet
Ali Aydınlar, while the scandal erupted. 6 months later, he resigned and told on several TV
programmes that he did not want to be the president who relegated Fenerbahce
and not surprisingly, he announced last week that he runs for presidency of
Fenerbahce.
In February 2012, he was replaced by Mr. Yildirim Demirören, the
chairman of investigated and convicted Besiktas JK. The vice president and
manager of Besiktaş were sentenced to years in prison for match fixing offences
and Mr. Demirören was leading the team while this corruption took place. In
2010-2011, during his presidency of Beşiktaş, he claimed that there was match
fixing in Turkey and somehow Fenerbahce was supported illegaly to become champions.
These words of him are still on the official web page of the club. But all of a
sudden, when he became the president of federation, he has forgetten all... He
was the name Prime Minister Recep Tayyip Erdoğan appointed as the new leader of
Turkish football…
Here I have to
digress from my point a little to express the overall approach of Turkish
politicians to the case. In November 2011, Turkish parliament gathered to amend
the Sports Law no 6222 “The
Prevention of Violence and Disorder in Sports” that came into effect just 7 months
ago. Eventually, all sentences that penalise crimes in sports including mainly
match fixing were reduced. This was a heartbreaking time for true football
lovers since it was very obvious why the amendment were done in such a hurry…
First job of
the new federation was to change the disciplinary committees. Members of
Professional Football Discipline Committee and Ethical Committee were replaced.
These changes followed by amendments of disciplinary codes that covered relegation
punishments for match
manipulation and attempts.
Fenerbahce
officials, leading newspapers and journalists were forcing federation to change
these regulations claiming that Turkish football economy would sink otherwise,
I mean, in case of relegation penalties.
And in March 2012, Turkish
Prime Minister Recep Tayyip Erdogan offered a suggestion to Michel Platini
during UEFA congress in Istanbul. Mr.
Erdoğan stated that individuals
involved in match-fixing should face punishment, warning that sanctions against
football clubs could mean punishment of millions of fans. This idea of the most
powerful man in Turkey pointed the method of how the federation should solve
the problem and keep the fixer clubs in top division.
As a matter of
fact, the federation respectively
changed the Article 24 and
then, in 30th April 2012, the
code 58 crossed out the relegation penalty for clubs regarding “match fixing
attempts.” Please pay attention to the detail… “Relegation penalty for match
fixing attempts…” was crossed out of the discipline procedures.
President Demirören created a new term and
claimed that “match fixing activities were not reflected in to the pitch.” His
perspective, however, contrasts with UEFA Disciplinary Regulations and leading
cases of CAS.
In May 02, brand-new
and guided Ethical Committee announced its final report and limited the match
fixing activities with merely “attempts” ignoring the first report which said
there were match fixing in 11 games and attempts in 3 others. As I said a few
seconds ago, the relegation penalty for match fixing attempts were crossed out
just two days before the new report :) The committee concluded that “alleged
attempts to fix games had not altered the course of the matches.”
Later on,
Professional Football Discipline Committee punished officials, players,
managers and employees of 6 clubs over attempting to fix the results of matches
although it claimed that professional clubs could not be blamed over
individuals’ activities and cleared them all. "There is no reason for
punishment since the elements of the alleged disciplinary violation have not
materialised," the federation said in its statement. This irrational
description of match fixing could mean the end of integrity, which is the most
valuable commodity in sports.
As it is very
clear, the renewal of federation and the interventions of politics reversed the
match fixing storm and directed it in favour of Fenerbahce.
Recognized
with their passion for the game, Turkish
people are now feeling what they watch is not football, it is just a free
theatre performed by million-dollar players. They lost their faith to the
authorities in Turkey. Stadiums are full of posters and cheerings referring
match fixing in almost every game and clashes between fans are very common.
Trabzonspor fans, particularly, are expecting their title to be registered.
Tireless fans struggle
to maintain their legitimate campaign against corruption in this lovely sport
and try to keep the case on the agenda. They organize demonstrations in several
countries of Europe and hold protests outside the headquarters of UEFA, FIFA and
TFF. Millions of complaints are sent to UEFA and FIFA. Yes, UEFA excluded Fenerbahce
and Besiktas from editions of European tournaments but the decision making
process was inconceivably too long. The final verdicts are true but partial.
UEFA is yet to make its decisions on individuals. The leading football
authorities should act as soon as possible to kick corrupted figures out of
Turkish football. In Poland, Germany, Italy, Portugal, Macedonia, Finland,
Greece and many more European countries, match fixer clubs were relegated and
the officials were banned for life from football. So we can ask here, what was
the worse thing Olympiakos Volou has done to be relegated to the semi
professional league in Greece? What did Juventus do so inexcusable? Does anyone
remember Finnish football club Tampere United who was indefinitely suspended
from football for accepting payments from a person known for match-fixing? Or
let me ask in another way... What keeps match fixer clubs in top division in
Turkey? How can Aziz Yıldırım still be the chairman of Fenerbahce officially?
Why does UEFA play for time? Another question... What was the crime of Salzburg
that was forced to play against Fenerbahce and lost its possible chance to play
in Champions League? One can easily multiply the questions... But I don’t have
that much time. I hope I made my point here.
In his work
“Thoughts” Pascal states that – I’m quoting here, “We cannot give might to justice,
because might has gainsaid justice and has declared that it is she herself who
is just. And thus, being unable to make what is just strong, we have made what
is strong just.”
This passage
is the summary of what happened in Turkey in the last two years. The might of
possessing political support, economical potential and media contribution
determined what is just in Turkish football ignoring the crucial results it may
lead to.
And now, as i
said before, football authorities should act as soon as possible to settle the
justice in Turkish football through law enforcement. Otherwise, the most
popular game in sports will gradually become more of a fairy tale than a fair
play in Turkey."

Bugün size Türkiye’deki gerçek durumu anlatmaya ve Avrupa
futbolunun en büyük skandallarından birinin başından bu yana son iki senede
Türkiye’de gerçekten ne olduğu konusunda bilgi vermeye çalışacağım. Zannederim ki
skandal uzaktan bakıldığında doğru bir şekilde ele alınmış görünüyor ancak gerçek
bu değil.
Bildiğiniz üzere şikenin birçok farklı tanımı var ancak
benim en çok sevdiğim, UEFA yetkilisi Graham Peaker’ın tanımı. Kendisi şikeyi
daha şiirsel bir biçimde “kaybetmek için hile yapmak” olarak tanımlıyor. Ancak dünyanın
bazı bölgelerinde, Türkiye gibi, eğer şu üç kritik gücü elinizde
bulunduruyorsanız, kaybetme sanatının üstesinden gelmek o kadar da zor değil.
Bunlar:
Siyaset, ekonomi ve medya gücü.
Türkiye’deki şike skandalının baş
öznesi bu üçlünün tamamını elinde bulunduruyordu ve hepsinden de iyi biçimde
faydalandı.
Temmuz 2011’de,
polis soruşturması birçok maçta şikeye karışan bir organize suç örgütünü ortaya
çıkardı. Fenerbahçe kulübü skandalın merkezindeydi ve yöneticileri bahar 2011’deki
12 maçta şike yapmayla suçlanıyordu; sonucunda Fenerbahce, 17 maçta 16
galibiyetlik inanılmaz bir seri ile Trabzonspor’un önünde ligi şampiyon
tamamlamıştı. Fenerbahçe kulübü başkanı Aziz yıldırımın da aralarında bulunduğu
onlarca yönetici göz altına alınmış, birçok oyuncu, teknik director ve menajer
de şike soruşturmasında suçlanmıştı. Bir tam senenin üzerine, mahkeme 2 Temmuz
2012’de kararlarını açıkladı ve 21 kişiyi 2010-2011 sezonu maçlarını manipüle
etmekten ötürü cezalandırdı.
Türkiye süper ligi ve birinci ligindeki şike eylemleri
kanıtlanmış olmasına karşın, sportif yargı kulüpleri hak ettiği cezaları almaktan kurtarmak
amacıyla manipüle edildi. Yasalar, yönetmelikler, kurallar ve raporlar
değiştirildi, kişiler ve kurumlar birbirinden ayrıldı ve böylece kendi
yöneticilerinin şike eylemlerinden faydalanan kulüpler, kulağa inanılmaz gelse
de aklandı.
Fenerbahçe ve Beşiktaş UEFA’nın disiplin komiteleri
tarafından da suçlu bulundu ve cezalandırıldı. Ancak Türkiye futbol federasyonu
verdiği adaletsiz ve mantıksız kararları hukuka uygun bir biçimde düzenlemek
niyetinde değil.
Şike yapan kulüpleri aklama sürecini, siyasi ve ekonomik arzular
ve kirli medyanın desteğiyle şekillenen üç temel adımla özetleyebiliriz.
Türkiye futbol
federasyonu, şike skandalı patladığında eski Fenerbahçe yönetim kurulu üyesi ve
tutkulu bir taraftar olan Mehmet Ali Aydınlar tarafından yönetiliyordu. Aydınlar
6 ay sonar istifa etti ve akabinde çeşitli televizyon programlarında Fenerbahçe’yi
küme düşüren başkan olarak anılmak istemediğini ifade etti. Ve hiç de şaşırtıcı
olmayan bir biçimde, geçtiğimiz hafta Fenerbahçe başkanlığı için adaylığını
açıkladı.
Şubat 2012’de, Aydınlar’ın yerini Yıldırım Demiröre aldı. Demirören, ceza
alan beşiktaşın başkanıydı. Beşiktaş’ın as başkanı ve teknik direktörü de şike suçlamalarıyla
çeşitli yıllarda cezalara çarptırılmıştı ve bu olaylar yaşandığında Demirören
kulüp başkanlığı yapıyordu. Kendisi, Başbakan Recep Tayyip Erdoğan’ın Türk
futbolunun yeni lideri olmasını istediği isimdi.
Bu noktada
biraz konudan saparak, Türk siyasilerin konuya genel yaklaşımını belirtmek
istiyorum. Kasım 2011de, Türk parlamentosu toplanarak, henüz 7 ay önce
yürürlüğe konan 6222 nolu Sporda şiddet yasasını değiştirdi. Bunun sonucunda, başta
şike olmak üzere, tüm spor suçlarının cezaları düşürüldü. Hakiki futbolseverler
için bu içler acısı bir durumdu size yasa değişikliğinin bu kadar alelacele
yapılmasının sebebi çok açıktı.
Yeni federasyonun
ilk işi disiplin komitelerini değiştirmek oldu. PFDK ve Etik komitesi üyeleri
değiştirildi. Bunun arkasından, maç sonucunu etkilemek ya da teşebbüste
bulunmak suçlarına yönelik küme düşme cezalarını da kapsayan disiplin maddeleri
de değiştirildi.
Fenerbahçe yöneticileri,
önde gelen gazeteler ve gazeteciler federasyonu bu disiplin kurallarını
değiştirmeye zorluyor, aksi takdirde Türk futbol ekonomisinin batacağını iddia
ediyordu. Yani küme düşme cezalarının verilmesi halinde.
Ve mart 2012de, Başbakan
Recep Tayyip Erdoğan İstanbul’daki UEFA kongresi sırasında Michel Platiniye bir
öneride bulundu. Erdoğan, şikeye bulaşan kişilerin ceza alması gerektiğini,
ancak futbol kulüplerine verilecek cezaların milyonlarca taraftarın
cezalandırılması anlamına geleceğini söylüyordu. Türkiye’nin en güçlü adamının
bu fikri, federasyonun şike sorununun çözüm ve şike yapan kulüplerin ligde tutulmasının
yöntemini işaret ediyordu.
Sonuç olarak,
federasyon önce 24. Maddeyi, arkasından 30 nisan 2012’de 58. Maddeyi değiştirdi.
58. Maddedeki “şike teşebbüsü” için küme düşme cezası çıkarıldı. Lütfen buradaki
detaya dikkat edin. “Şike teşebbüsüne küme düşme cezası” disiplin
prosedürlerinden çıkarılıyordu…
Bu sırada başkan
Demirören yepyeni bir terim yaratıyor ve şike eylemlerinin sahaya yansımadığını
iddia ediyordu. Ancak bu bakış açısı, UEFA Disiplin yönetmelikleri ve CAS’ın
önde gelen davalarındaki tutumuyla çelişiyordu.
2 Mayısta,
yeni ve güdümlü Etik Komitesi son raporunu yayınları da şike aktivitelerini
yalnızca “teşebbüsler” ile sınırlandırdı. Bu, 11 maçta şike ve 3 maçta teşebbüs
olduğunu söyleyen ilk raporla çelişiyordu. Az önce belirttiğim üzere, şike
teşebbüsü için küme düşme cezası yeni rapordan sadece iki gün önce ortadan
kaldırılmıştı. Komite, iddia edilen teşebbüslerin maç sonuçlarını
etkilemediğini söylüyordu.
Daha sonrasında
PFDK 6 kulübün yönetici, oyuncu, teknik direktör ve çalışanlarını maç
sonuçlarını belirlemek suçundan cezalandırdı ancak profesyonel futbol
kulüplerinin kişilerin eylemlerinden ötürü sorumlu tutulamayacağını iddia
ederek kulüplerin hepsini akladı. “Disiplin ihlal unsurlarının gerçekleşmediği
gerekçesiyle cezaya gerek görülmemiştir” deniliyordu federasyon açıklamasında. Bu
akıl dışı şike tanımı, sporun en önemli varlığı olan doğruluk kavramının sonu
anlamına geliyordu.
Açıkça görüldüğü
üzere, federasyonun yenilenmesi ve siyasilerin müdahaleleriyle şike rüzgarı yön
değiştirmiş ve şike yapan kulüplerin lehine eser olmuştu.
Futbola düşkünlükleriyle
bilinen Türk taraftarlar artık izledikleri şeyin futbol olmadığını, sadece
milyon dolarlık oyuncularca icra edilen bedava bir tiyatro olduğunu
düşünüyorlar. Türkiye’deki otoritelere olan inanç kaybolmuş durumda. Stadyumlar
her maçta şike pankartları ve tezahüratlarıyla dolu, taraftarlar arasındaki
kavgalar olağan kabul ediliyor. Özellikle Trabzonspor taraftarları şampiyonluklarının
tescil edilmesini bekliyor.
Yorulmak bilmeyen
taraftarlar, bu güzel spordaki kirlenmeye karşı yürüttükleri haklı
mücadelelerini sürdürmeye ve şike konusunu gündemde tutmaya çalışıyorlar. Avrupanın
çeşitli ülkelerinde eylemler düzenliyor, UEFA FIFA ve TFF merkezleri önünde
protestolar yapıyorlar. UEFA ve FIFA’ya milyonlarca şikayet gönderiyorlar.
Evet, UEFA Fenerbahce ve Besiktası Avrupa kupalarından men etti fakat karar
verme süreci anlaşılmaz bir biçimde uzundu. Verilen kararlar doğru ancak
eksikti. UEFA hala kişilerle ilgili kararlarını vermiş değil. Önde gelen futbol
otoriteleri bir an önce harekete geçmeli ve kirli figürleri Türk futbolunun
dışına itmelidir. Birçok paralel örnek gösterebiliriz. Polonyada, almanyada,
portekizde, italyada, makedonyada, finlandiyada, yunanistanda ve birçok başka Avrupa
ülkesinde şike yapan kulüpler küme düşürülmüş ve şike yapan kişiler de
futboldan ömür boyu men edilmiştir. Bu noktada şu soruları yöneltebiliriz: Olympiakos
Volou, Yunanistan amatör ligine düşürülmek için şikeden daha kötü ne yapmıştı? Juventus’un
affedilmez suçu neydi? Herhangi biriniz, şikeyle tanınan bir kişiden para
aldığı gerekçesiyle futboldan ömür boyu men edilen, tescili iptal edilen Finlandiya
kulübü Tapmere United’ı hatırlıyor musunuz? Ya da başka bir biçimde soralım… Türkiyede
Şike yapan kulüpleri ligde tutan nedir? Bunun arkasındaki güç kim? Nasıl olur
da Aziz yıldırım hala Fenerbahçe’nin resmi başkanı olabilir? UEFA neden zamana
oynuyor? Soruları kolaylıkla çoğaltabilirsiniz. Ama yeteri kadar vaktim yok. Umarım
ne demek istediğimi anlatabilmişimdir.
“Düşünceler”
adlı eserinde Pascal şöyle der: “gücü adalete veremedik, çünkü güç, adalete
karşı çıkıp kendisinin adil olduğunu söylemişti. Haklı olanı güçlü
kılamadığımız için de güçlü olanı haklı kıldık.”
Bu pasaj, son
iki yılda Türkiye’de neler olduğunun özeti. Siyasi destek, ekonomik potansiyal
ve medya desteğini elinde bulundurmanın gücü, yaratacağı sonuçlara karşın, Türk
futbolunda neyin adil olduğuna karar vermiştir.
Ve işte, daha
önce de dile getirdiğim gibi, futbol otoriteleri bir an önce Türk futbolunda
hukuka uygun bir biçimde adaleti sağlamalıdır. Aksi takdirde, en çok sevilen
spor Türkiye’de yavaş yavaş adil oyun olmaktan çıkarak peri masalına
dönüşecektir.
